المقدمة Introduction شهد العالم في العقود الأخيرة تطورًا مذهلًا في تقنيات الثورة الرقمية، وفي مقدمتها الذكاء الاصطناعي، الذي يُعد اليوم أحد أكثر مظاهر الكيانات الرقمية تقدمًا وإثارة للجدل. فقد تجاوز الذكاء الاصطناعي كونه أداة برمجية تُستخدم لإتمام مهام بسيطة، وأضحى فاعلًا رقميًا له تأثير حاسم في مجالات متعددة، كالصحة، والصناعة، والتعليم، والعدالة، والأمن، والعلاقات الاجتماعية، وغيرها. وقد بات من المألوف الحديث عن سيارات ذاتية القيادة، وروبوتات قادرة على اتخاذ قرارات مستقلة، وخوارزميات ترسم خططًا علاجية أو اقتصادية دون تدخل مباشر من الإنسان. إلا أن لهذه الكيانات أثر سلبي على الإنسان فقد نجم عن استخدامها المساس بالمصالح المحمية قانونًا، لذا يؤدي ظهورها ، التفكير بشكل جديَّ حول التأثيرات المستجدة التي ستُحدثها هذه التقنية الثورية بما تملكه من إمكانيات متطورة ومقدرة على التصرف بشكل ذاتي ودون الحاجة لأي تدخل بشري، لذا تحتم ﻋﻠﻰ اﻟﻤﺸﺮع إﻋﺎدة ﺗﻜﯿﯿﻒ ﻗﻮاﻋﺪه اﻟﻘﺎﻧﻮﻧﯿﺔ ذات اﻟﻤﺪﻟﻮل اﻟﻮاﻗﻌﻲ واﻟﻤﺎدي من أجل التعامل ﻣﻊ واﻗﻊ إﻓﺘﺮاﺿﻲ ﻏﯿﺮ ﻣﻠﻤﻮس ﻓﻲ حالات متعددة تحديدًا ﻣﻊ مرحلة إﻧﺘﻘﺎل ﻓﻜﺮة اﻟﺬﻛﺎء الإﺻﻄﻨﺎﻋﻲ ﻣﻦ الإطار اﻟﻤﻌﻨﻮي ﻏﯿﺮ اﻟﻤﻠﻤﻮس واﻟﺨﺎص، إﻟﻰ الإطار اﻟﻤﺎدي اﻟﻤﺤﺴﻮس واﻟﻌﺎم، وﻣﻦ إطﺎر اﻟﺒﺮﻣﺠﯿﺎت سهلة التحكم إﻟﻰ ﻧﻈﺎم اﻟﺒﺮﻣﺠﯿﺎت اﻟﺬﻛﯿﺔ، ﺳﻮاء تعلق هذا الأمر بتطور قدرات البشر أو تطوير كينات الذكاء الإصطناعي من الناحية الفيزيائية أو المادية بصورة تحاكي البشر في تصرفاتهم وأفعالهم لذا الحاجة تستدعي التأطير القانوني للقواعد التي تحكم هذا الذكاء وتحديد المسؤولية المدنية والجنائية بصورتي العمد والخطأ الناجمة عن كل أخلال يصيب المصالح المحمية. ومع هذا الاتساع الهائل، برزت جملة من الإشكالات القانونية الجديدة، وفي مقدمتها السؤال الجوهري المتعلق بـ: من يتحمل المسؤولية الجزائية عندما يرتكب الذكاء الاصطناعي فعلاً مخالفًا للقانون؟ إن القانون الجنائي - بصفته أداة ضبط اجتماعي تهدف إلى حماية القيم الأساسية في المجتمع - يجد نفسه اليوم أمام امتحان صعب، يتمثل في كيفية التفاعل مع كيان جديد لا تنطبق عليه أوصاف الإنسان الطبيعي ولا الشخص المعنوي، لكنه يمتلك قدرة على إحداث آثار جرمية فعلية، قد تكون مدمرة في بعض الحالات. فالذكاء الاصطناعي في نسخته الحديثة (وخاصة تلك التي تعتمد على التعلم العميق) بات يتمتع بقدر من "الاستقلالية" و"اللاتنبؤ"، مما يخلق فجوة واضحة بين أنظمة المسؤولية التقليدية، وبين الواقع العملي المتشكل من فعل أنظمة اصطناعية تزداد تعقيدًا. أهمية الدراسة تتجلى أهمية هذه الدراسة في عدة مستويات، أبرزها: ⮚ المستوى النظري: إذ تسعى إلى إثراء الفقه القانوني بمناقشة معمقة لإحدى أهم قضايا العصر الرقمي، وتسهم في إعادة تفكيك مفاهيم المسؤولية والفاعل في ضوء تطورات تكنولوجية متسارعة. ⮚ المستوى التشريعي: حيث تهدف إلى تقديم رؤية قانونية تساعد المشرّع على ملء الفراغ القائم بشأن الذكاء الاصطناعي، واقتراح قواعد قانونية أو تعديل قائمة تتماشى مع متطلبات العدالة في العصر الرقمي. ⮚ المستوى القضائي والعملي: حيث تقدم إطارًا تحليليًا يمكن أن يفيد القضاة، والباحثين في معالجة القضايا المتعلقة بأخطاء أو جرائم سببها الذكاء الاصطناعي. ⮚ المستوى المستقبلي: إذ تُعدّ هذه الدراسة مساهمة استشرافية نحو بناء منظومة جزائية أكثر تكيّفًا مع تحديات الغد، خاصة مع تصاعد الحديث عن "شخصية قانونية اصطناعية" في بعض الفقه الغربي. مشكلة الدراسة تنطلق هذه الدراسة من إشكالية رئيسة تتمثل في: مدى قابلية النظام الجنائي التقليدي للتعامل مع الأفعال الإجرامية الناتجة عن أنظمة الذكاء الاصطناعي، وتحديد الطرف الذي ينبغي أن يتحمل المسؤولية الجزائية عنها. وتفرّع عن هذه الإشكالية مجموعة من التساؤلات الفرعية، من بينها: ⮚ هل الذكاء الاصطناعي يمكن اعتباره فاعلًا للجريمة أم مجرد أداة؟ ⮚ في حال استبعاد شخصيته القانونية، من يتحمل تبعة أفعاله غير المشروعة؟ هل هو المطور، أم المبرمج، أم المستخدم، أم صاحب البيانات؟ ⮚ ما مدى كفاية القواعد القائمة في الإسناد، والعقوبة، والركن المعنوي، لمواجهة هذه النوعية من الأفعال؟ ⮚ وما هي أبرز التجارب المقارنة التي حاولت الاستجابة لهذه التحديات، وكيف يمكن الاستفادة منها في السياق التشريعي العربي والعراقي؟ منهج الدراسة تقتضي طبيعة هذه الدراسة الاعتماد على منهج تحليلي نقدي مقارن، حيث تم تحليل النصوص القانونية التقليدية ذات الصلة بأركان المسؤولية الجزائية، ومحاولة إسقاطها على الواقع الجديد الذي يطرحه الذكاء الاصطناعي. كما تم تتبع أبرز الاتجاهات الفقهية في التعامل مع هذه المسائل، واستعراض جهود بعض الدول، خاصة الاتحاد الأوروبي، في تقديم أطر قانونية مبدئية للتعامل مع هذه الظاهرة. وتم التطرق إلى حالات عملية وأمثلة تطبيقية تساعد في توضيح الإشكالات النظرية، وقياس مدى تماسك الطروحات المطروحة. خطة الدراسة جاءت الدراسة موزعة على فصلين، تم ترتيبها وفق تسلسل منطقي يبدأ من المفاهيم الأولية، مرورًا بتشخيص الواقع، وانتهاءً بالمعالجة القانونية المقترحة وفقًا للتالي: ⮚ الفصل الأول: الإطار المفاهيمي والتاريخي للذكاء الاصطناعي. ⮚ الفصل الثاني:المسؤولية الجزائية الناشئة عن جرائم كيانات الذكاء الإصطناعي. ويُختتم هذا الكتاب بخاتمة تتضمن أهم النتائج والتوصيات، والتي نأمل أن تكون خطوة أولى نحو تأسيس قاعدة علمية للتشريعات المستقبلية التي تتعامل مع الذكاء الاصطناعي كواقع قانوني، وليس فقط كظاهرة تقنية.
