مقدمة introduction تُعد تقنيات الذكاء الاصطناعي قاطرة الثورة الصناعية الرابعة، إذ تجاوزت حدود البرمجة التقليدية إلى التعلم العميق الذي مكّن الآلات من تنفيذ مهام بشرية معقدة، مثل تحليل الصور، ومعالجة اللغات الطبيعية، وإنتاج محتوى إبداعي. فأصبحت التطبيقات تعتمد على الذكاء الاصطناعي في جميع القطاعات، من الرعاية الصحية إلى التعليم، ومن الأمن إلى الفنون. ومع ذلك، مثلما أن كل تقدم يحمل في طياته إمكانات هائلة، فإنه يجلب معه تحديات وأخطارًا جديدة. كان للثورة الرقمية التي ظهرت في القرن العشرين أثر في إحداث تأثيرات جذرية تضمنت نواحي الحياة المختلفة، خصوصًا في المجال الإقتصادي، والتي تمثلت بثلاث صور ( الذكاء الإصطناعيArtificial Intelligence( AI) وإنترنت الأشياء Internet of Things والبيانات الضخمة Big Data ، وفيما يتعلق بالذكاء الإصطناعي، فقد تم إكتشافهُ في منتصف خمسينات القرن الماضي الذي تعد الولادة الحقيقية لهُ في المؤتمر الذي نُظم في الولايات المتحدة الأمريكية على يد العالمان John McCarthyو Marvin Minsky، وعلى مرًّ السنين تطورت تقنيات الذكاء الإصطناعي بشكل متسارع الى أن وصلت بعض التطبيقات أن تكون لها القدرة على التعلم الذاتي من المواقف التي تمرًّ بها، فتتصرف بأستقلالية وفقًا للظروف والمواقف المحيطة بها، كالطأئرات المسيَّرة ذاتيًا والسيارت ذاتية القيادة والروبوتات وغيرها، وعلى الرغم من الفوائد التي لاتُعّد ولا تُحصى للذكاء الإصطناعي وتطبيقاته في المجالات الطبية والعسكرية والتعليمة وغيرها، إلا أن لهذه التطبيقات أثر سلبي في الإنسان، فقد نتج عن استخدامها المساس بالمصالح المحمية قانونًا، لذا يؤدي ظهورها ، التفكير بشكل جديَّ حول التأثيرات المستجدة التي ستُحدثها هذه التقنية الثورية بما تملُكه من إمكانيات متطورة ومقدرة على التصرف بشكل ذاتي ودون الحاجة لأي تدخل بشري ، لذا تحتم ﻋﻠﻰ اﻟﻤﺸﺮع إﻋﺎدة ﺗﻜﯿﯿﻒ ﻗﻮاﻋﺪه اﻟﻘﺎﻧﻮﻧﯿﺔ ذات اﻟﻤﺪﻟﻮل اﻟﻮاﻗﻌﻲ واﻟﻤﺎدي من أجل التعامل ﻣﻊ واﻗﻊ إﻓﺘﺮاﺿﻲ ﻏﯿﺮ ﻣﻠﻤﻮس ﻓﻲ حالات متعددة، تحديدًا ﻣﻊ مرحلة إﻧﺘﻘﺎل ﻓﻜﺮة اﻟﺬﻛﺎء الإﺻﻄﻨﺎﻋﻲ ﻣﻦ الإطار اﻟﻤﻌﻨﻮي ﻏﯿﺮ اﻟﻤﻠﻤﻮس واﻟﺨﺎص، إﻟﻰ الإطار اﻟﻤﺎدي اﻟﻤﺤﺴﻮس واﻟﻌﺎم، وﻣﻦ إطﺎر اﻟﺒﺮﻣﺠﯿﺎت سهلة التحكم إﻟﻰ ﻧﻈﺎم اﻟﺒﺮﻣﺠﯿﺎت اﻟﺬﻛﯿﺔ، ﺳﻮاء تعلق هذا الأمر بتطور قدرات البشر أو تطوير تطبيقات الذكاء الإصطناعي من الناحية الفيزيائية أو المادية بصورة تُحاكي البشر في تصرفاتهم وأفعالهم، لذا الحاجة تستدعي التأطير القانوني للقواعد التي تحكم هذا الذكاء وتحديد المسؤولية المدنية والجنائية بصورتي العمد والخطأ الناجمة عن كل أخلال يصيب المصالح المحمية. تتطور الجرائم الإلكترونية بسرعة مع تقدم التكنولوجيا وبلوغها أبعادًا جديدة بطريقة تطمس الخطوط الفاصلة بين ما هو حقيقي وما هو مُحاكى. أصبحت تقنية التزييف العميق Deepfake جزءًا من الجرائم الإلكترونية. تتميز تقنية التزييف العميق Deepfake بأن لها ميزات مماثلة لتقنية CGI ( Computer Generated Images) في نطاق صناعة السينما، مما يجعل من الممكن إنشاء مقاطع فيديو - صور ومقاطع صوتية باستخدام أذرع الذكاء الإصطناعي وبطريقة واقعية للغاية يصعُب على البشر التعرُف عليها على أنها مُزيفة. وهذا يفرض مخاطر جسيمة، مع عواقب محتملة تتراوح من ممارسات إنتخابية غير عادلة إلى إستخدام أدلة مزورة في المحكمة. لقد ظهرت هذه التقنية لأول مرة في عام 2017 في منصة التواصل الإجتماعي التي تُسمى Reddit . وعلى الرغم من أن هذه التقنية لها العديد من الاستخدامات المشروعة، إلا إن استخداماتها غير المشروعة أكثر بروزًا، مما نتج عنها المساس بالمصالح المحمية قانونًا. لذا يؤدي ظُهور هذه التقنية التفكّير بشكلًا جديًا حول الإنتهاكات الخطيرة للمصالح المحمية قانونًا. لذا يتحتم على المُشرع الجزائي إعادة تكييف القواعد القانونية ذات المدلول الواقعي – المادي، من أجل التعامل مع واقع إفتراضي غير ملموس ومحاولته تجريم السلوكيات الناجمة عن هذه التقنية. فضلًا عن الإهتمام بسياستي المنع والوقاية من الجرائم التي تنشيء عن التزييف العميق. التزييف العميق (Deepfake) يُمثل أحد أكثر المخرجات المثيرة للجدل في عالم الذكاء الإصطناعي. هذه التقنية، التي تستند إلى الشبكات العصبية التوليدية (GANs)، قادرة على إنتاج محتوى وسائط مرئية وسمعية يبدو حقيقيًا بشكل مذهل. على الرغم من الاستخدامات الإيجابية للتزييف العميق، مثل تحسين جودة الأفلام أو التفاعل الافتراضي، إلا أن الجانب السلبي يثير قلقًا عالميًا. اهمية الدراسة Research Objective: تتجسد أهمية الموضوع في إﻨﺘﺸـــﺎر تطبيقات اﻟـــذﻛﺎء الإﺼــطﻨﺎﻋﻲ ﻓـــﻲ ﻤﺨﺘﻠـــف ﻤﺠﺎﻻت اﻟﺤﯿﺎة، وقد ساهم ﻤﻊ ﻫـذا الإﻨﺘﺸـﺎر إلى ازدياد ﺘطﺒﯿﻘﺎﺘﻬـﺎ اﻟﻤﺴـﺘﺨدﻤﺔ واﻟﻤﺘﻤﺜﻠـﺔ ﺒـﺎﻵﻻت واﻟﺒـراﻤﺞ اﻟذﻛﯿﺔ، ﻤﻤﺎ ﻗد يسهم في التسبب ﻓـﻲ إرﺘﻛـﺎب الإفعال الجرمية، اﻷﻤـر اﻟـذي ﯿﺴـﺘﻠزم ﺘﺤدﯿـد اﻟﺸـﺨص اﻟﻤﺴـؤول ﺠﻨﺎﺌﯿـــًﺎ ﻋﻨﻬـــﺎ، ﺴـــواءً ﻛﺎﻨـــت ﻨﺘﯿﺠـــﺔ ﻓﻌـــل ﺼـــﺎدر ﻋـــن اﻹﻨﺴـــﺎن، أو ﻨﺘﯿﺠـــﺔ ﻗـــدرة هذه التطبيقات ﻋﻠـــﻰ ﺘﺒﻨـــﻲ اﻟﻘواﻋـــد واﻟﻤﻌــﺎﯿﯿر اﻟﺨﺎطﺌــﺔ ﺒﺼــورة ﻤﺴــﺘﻘﻠﺔ، ﻟﻤــﺎ ﺘﺘﻤﺘــﻊ ﺒــﻪ ﻤــن ﺨﺼــﺎﺌص ﻓرﯿــدة ﺘﻤﻨﺤﻬــﺎ اﻟﻘــدرة ﻋﻠــﻰ ﻤﺤﺎﻛــﺎة سلُوكنا اﻟﺒﺸري، وﻤن ﺜَمّ ﻛﺎن ﻀـرورﯿًا ﺒﺤـث ﻤوﻀـوع اﻟﻤﺴـؤوﻟﯿﺔ اﻟﺠزائية اﻟﻨﺎﺸـﺌﺔ ﻋـن جرائم الذكاء الإصطناعي وﻓــقًا للتشريعات اﻟﺠﻨﺎﺌﯿــﺔ اﻟﺤﺎﻟﯿــﺔ، ﻤــن أﺠــل ﺘﺤدﯿــد اﻟﻤﺴــؤول اﻟﺤﻘﯿﻘــﻲ ﻋــن اﻟﺠــراﺌم الناشئة عن استخدام تطبيقات الذكاء الإصطناعي وإيقاع الجزاء القانوني المناسب وفقًا لمبادئ المسؤولية الجزائية. كما سنستعرض دور الذكاء الاصطناعي في في تقنية التزييف العميق، ونتعمق في تحليل الأساليب التي تعتمدها لتضليل الأفراد والمؤسسات، كما نناقش التبعات القانونية والأخلاقية لهذه الجرائم. ولأن مواجهة هذه الظاهرة لا يمكن أن تتحقق دون جهود مشتركة، نتناول أيضًا الحلول التكنولوجية، الإطارات القانونية، والاستراتيجيات التوعوية التي يمكن أن تسهم في التصدي لها.كما أن هذا الكتاب ليس مجرد استعراض لتحديات التزييف العميق، بل هو دعوة للتفكير والعمل الجماعي لصياغة مستقبل نستخدم فيه الذكاء الاصطناعي كأداة لبناء مجتمعات أكثر أمانًا واستدامة. مشكلة الدراسة Research Problem: تتمحور الأشكالية في مدى كفاية النصوص القانونية التقليدية الحالية أوالمستجدة في مواجهة الجرائم الناشئة عن تطبيقات الذكاء الإصطناعي، فضلًا عن مدى أمكانية مسائلة الذكاء الإصطناعي عن الجرائم الناشئة عن استخدمه وما موقف الفقه القانوني منها، ومن هم أطراف المسؤولية الجزائية في جرائم الذكاء الإصطناعي؟. كما أن التزييف العميق Deepfake يعد من الظواهر الإجرامية المستحدثة في مجال العلم الجنائي، ومثار نقاش فقهي وقانوني، ذلك لأن التطور المخيف في تكنولوجيا الإتصالات والذكاء الإصطناعي قد أحدث ثورة في مختلف الأصعدة، وكان له تداعيات إقتصادية – إجتماعية – جيوسياسية، وأنتقل الذكاء الإصطناعي من المفهوم الضيق ذو البعد الواحد (القدرة على القيام بمهام فردية كالتعرف على الوجه والترجمة مثلًا) إلى المفهوم العام متعدد المهام (القيام بمهام معقدة بطريقة تحاكي الأدمغة البشرية)، كما أن تطبيقات وتقنيات الذكاء الإصطناعي ومنها التزييف العميق ستكون مُستقبلًا رافدًا لإرتكاب مختلف الجرائم وذلك لتأثيرها على المصداقية الاعلامية، والابتزاز والخصوصية فضلا عن تأثيرها على الأمن القومي والجريمة المنظمة في ظل الفجوة التشريعية ، كما ستكون سلاحًا خطيرًا وقليل الكلفة في الحروب الحديثة " الحروب السيبرانية". منهجية الدرسة Research Methods: سيتم الإعتماد على المنهج التحليلي والإستقرائي للنصوص القانونية ذات الصلة بموضوع البحث بغية دراسة الموضوع، والمنهج التاريخي الذي سيهم في معرفة مراحل التطور الزمني للذكاء الإصطناعي. والمنهج الوصفي الذي يعتمد على جمع المعلومات والحقائق من مختلف المصادر التي تتعلق بتقنية التزييف العميق للتشريعات المختلفة. لغرض احتواء أشكالية البحث المطروحة، أرتأينا تقسيم الكتاب على فصلين وعلى النحو الآتي: الفصل الأول: المسؤولية الجزائية الناشئة عن جرائم الذكاء الإصطناعي. الفصل الثاني: المواجهة الجنائية للجرائم الناشئة عن إستخدام تقنية التزييف العميق.
