يعتبر الدستور القانون الأسمى في الدولة، فهو يبين شكل الدولة ونظام الحكم القائم فيها، ويحدد سلطاتها العامة وعلاقة بعضها بالبعض الآخر من جهة وعلاقتها بالأفراد من جهة أخرى ، وهذا ما نص عليه المشرع الدستوري العراقي وفق دستور (2005). إلا أن إحدى السلطات العامة في الدولة في بعض الأحيان قد تلجأ إلى إيقاف العمل ببعض نصوص الدستور دون الإستناد إلى نص دستوري يعطيها صلاحية القيام بهذا العمل وهذا ما إصطلح على تسميته

      تُعدّ قاعدة التكليف بغير المقدور أو بما لا يُطاق من أوائل المسائل التي بُحثت في علوم مختلفة، وصارت مثار بحث بين العلماء بمختلف اختصاصاتهم، ولعل أول من بحثها هم المتكلمون لعلاقتها بمسألة الحسن والقبح العقليين، التي تعد من أمهات المسائل الكلامية، التي كانت من السمات المهمة التي ميزت بين العدلية –المعتزلة والإمامية- والأشاعرة.
