لقد أثارت فكرة القانون الطبيعي اهتمام الفقهاء والفلاسفة في الشرق والغرب ، القدامى منهم والمحدثون وشيدوا نظريات وأقاموا مناقشات حول فكرة القانون الطبيعي والطبيعة والعقل الطبيعي مما جعل هذه الفكرة تبدو إحدى المعطيات الأساسية للفكر الإنساني والتي لا يمكن تجاوزها في إي وقت أو في إي مكان. يبدو إن مفهوم القانون الطبيعي وان كان يعد من اعرق المفاهيم الفلسفية إلا انه يعد واحد من تلك المفاهيم التي وان احتفظت بجوهرها

There are many opinions about modern political thoughts for future , trying to draw a map of strong powers in the world and one of these thoughts is the conflict with civilizations. Both of these phenomena search for future and western civilization. It is important to mention that Islamic civilization has special place and clear effect through its conditions.

The Islamic civilizational project has become anurgent necessity when Muslims and Arabs faced in recent years, with serious of challenges and the dangers that surrounded them; Globalization is one of these challenges.

The contractual imbalance is perceived today by the majority of the doctrine as being one of the pitfalls to the execution of the contracts. As a result, most legislations grant judges the power to intervene to restore it. Granting the judge the power to complete the contract raises the question of the extent to which the judge can obtain such power. Is it an absolute authority that is not limited? If so, is it a broad discretion in which the judge operates in his conscience, or is it a power of limited scope by specific legal texts and conventions? Founding a System to secure deposits and protecting the depositors is considered one of the important and exchanged subjects out there in the banking system/field in Iraq at the current time, and the reason behind the exchange and spread of this subject is due to the financial crisis of which the banking sector is suffering from and the stumbling of many banks, those factors have had led to the insecurity of the depositors and their mistrust towards banks, thus, it is necessary to create a system to secure deposits in which depositors would be compensated for the losses caused by the banks' failures. in addition, it could be a countermeasure system which maintains the banking stability, protects the rights of depositors and gains

Each school of Islamic jurisprudence has principles and rules upon which the diligent work in these schools is based. This is due to the view of sanctification of these rulings, as they are divine rulings. Therefore, the goal is to reach a ruling that represents the intent of the legislator as much as possible.
