Abstract

This research studies Abu Baker Al-Siddiq’s commandments to the leaders of his armies. The research is organized into an Introduction, three sections, and a Conclusion.

The Introduction presents a definition of Style and Commandment terminologies. It also presents a brief biography of Abu Baker Al-Siddiq may Allah be pleased with him.

The first section explains the characteristics of the Composition and its rhetorical significance. In this Section, I study the types of predicate and the methods of construction in Abu Baker’s commandments and the rhetoric in using the connection and disconnection modifiers in his expressions.

The safety of state may be threatened by the exceptional circumstances such as the wars and normal disasters. Those circumstances make the state unable to protect the general system by using public rules. So the authority of control organization should expand to control such circumstances. Those authorities should report hasty and definitive steps to encounter such issues. The exceptional circumstances may directly affect the personal rights and freedom that were warranted by the constitution. So the legislator should determine the constraints that were adopted upon them and showed the guarantees of those liberties in order to avoid the unfair decisions and orders. 

This study is about the subject of exclusion of the application of foreign law as it violates the Islamic Sharia law in terms of Article (27) of the UAE Civil Transactions Law as amended in 2020, which before that date included all disputes involving a foreigner. According to the amendment referred to, the application of Islamic Sharia law shall be limited to civil transactions with the exclusion of personal status affairs.

The study concluded with many results, the most important of which is that the current text of Article (27) of the Civil Transactions Law as amended in 2020 is unable to explain what the judge may do in cases where the foreign law jurisdiction is referred to in one of the excluded texts, namely those related t
