   يهدف هذا البحث إلى تأصيل الاستدلال بالقاعدة الفقهية، وبيان ضوابطه، وإبراز نماذج من أهم تطبيقاته المعاصرة. وقد اعتمد مناهج من أهمها المنهج الاستقرائي والمنهج المقارن.
