ملخـــص البحــــث

جاءت هذه الدراسة لبيان مفهوم الاجتهاد المصلحي في المذهب المالكي، وضوابط العمل بالمصلحة في الشريعة الإسلامية والتي ينبغي مراعاتها عند النظر بالأحكام؛  ليكون الحكم موافقًا للشرع، ومستندا على القواعد والأسس التي ينبغي مراعاتها في النظر والاستدلال.

 وتضمنت هذه الدراسة مسوغات الاجتهاد المصلحي، وعلاقته بالمقاصد الشرعية، ثم ذكر بعض النماذج التطبيقية:
