شرط المنع من التصرف في القانون المدني العراقي: دراسة مقارنة

الحمد لله رب العالمين، والصلاة والسلام على محمد سيد المرسلين وعلى آله الطيبين الطاهرين.

أما بعد

      فلم يعد حق الملكية في العهد الحالي كما كان العهد عليه في العهود السابقة حقاً مطلقاً، بل أصبح حقا مقيداً بقيود متعددة تزداد يوما بعد يوم، وما شرط المنع التصرف الا صورة من هذه القيود.

      وهذا البحث هو محاولة متواضعة لدراسة هذا الشرط في القانون المدني العراقي عقارنا بالقانونين المصري والفرنسي. فأما القانون المدني المصري فبوصفه مصدراً استقى منه القانون المدني العراقي بعض احكامه، واما القانون المدني الفرنسي فبوصفه انموذجاً يحتذى به في الدراسات القانونية. كما سنعرج على موقف الفقه الإسلامي من الشرط المذكور، فهذا الفقه هو المورد الذي استقى منه القانون المدني العراقي جل احكامه، بل انه وكما تنص المادة الاولى منه يعدا مصدرا من مصادر القاعدة القانونية يأتي في الترتيب ثالثا بعد التشريع والعرف. والاهم من هذا كله، هو اننا اليوم في اشد الحاجة لدراسة فقهنا الاسلامي بعد ان اثبت التطبيق العملي انهيار أحد النظامين الرئيسين في العالم وقصور النظام الاخر، ثم ان بوادرا تلوح في الافق تدل على ان اليوم الذي يخرج فيه هذا النتاج العظيم من بطون الكتب الى واقع الحياة من جديد ليس بالأمر البعيد.

وسنقسم خطة البحث بعد التمهيد الى اربعة مباحث وكما يأتي:

المبحث الاول: النطاق القانوني لشرط المنع من التصرف.

المبحث الثاني: التكييف القانوني لشرط المنع من التصرف.

المبحث الثالث: الموقف القانوني من شرط المنع من التصرف.

المبحث الرابع: احكام شرط المنع من التصرف.
